Terms of Services
1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the Shipley Pediatrics website and its publicly available content, features, forms, and links (collectively, the “Website”). The Website is operated by Shipley Neuro Pediatrics, LLC, doing business as Shipley Pediatrics (“Shipley Pediatrics,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.
2. Website Information Is Not Medical Advice
The Website provides general educational and informational content about Shipley Pediatrics, pediatric healthcare topics, and the services we may offer. Website content is not intended to diagnose, treat, cure, prevent, or provide individualized medical advice for any condition.
Information on the Website should not replace evaluation, diagnosis, or treatment by a qualified healthcare professional. You should not delay or disregard professional medical advice because of information you read on this Website.
3. No Provider-Patient Relationship Created by Website Use
Using the Website, reading Website content, submitting a general inquiry, requesting information, or scheduling a non-clinical Meet & Greet does not, by itself, establish a provider-patient relationship with Jennifer Shipley, CPNP, Shipley Pediatrics, or Shipley Neuro Pediatrics, LLC.
A provider-patient relationship is established only when Shipley Pediatrics has accepted the patient for clinical care and any required registration, consent, financial, membership, or other applicable documents and processes have been completed.
4. Medical Emergencies and Urgent Concerns
The Website is not intended for medical emergencies, urgent medical concerns, or time-sensitive clinical communication.
If you believe your child or another person is experiencing a medical emergency, call 911 or go to the nearest emergency department.
Existing patients should use the communication methods provided by Shipley Pediatrics for patient-specific medical questions and follow the practice's current after-hours instructions when the office is closed.
5. Website Forms and Electronic Communications
General Website contact forms are intended for non-urgent, administrative inquiries. Unless a form is specifically identified as a secure method for transmitting health information, please do not submit medical histories, diagnoses, symptoms, medication information, Social Security numbers, insurance identification numbers, or other sensitive health or personal information through a general Website form.
Submitting a Website form or electronic message does not guarantee an immediate response. Do not use general Website communications for urgent or emergency medical needs.
6. Patient Portal
Shipley Pediatrics may provide links to a third-party patient portal or other secure healthcare technology. Access to those services may be governed by additional terms, privacy policies, and security practices established by the applicable service provider.
You are responsible for protecting your portal login credentials and for promptly reporting suspected unauthorized access through the appropriate support or practice channels.
7. Pediatric Direct Primary Care
Information on the Website about Pediatric Direct Primary Care (“DPC”), including descriptions of membership benefits, pricing, eligibility, and services, is provided for general informational purposes.
Enrollment in DPC is governed by the current written DPC Membership Agreement and any applicable practice policies. If Website content conflicts with a signed membership agreement or other controlling patient document, the applicable signed agreement or controlling policy will govern to the extent permitted by law.
DPC membership is not health insurance and does not replace health insurance coverage for services that are outside the membership or provided by other healthcare professionals, facilities, laboratories, pharmacies, hospitals, or specialists.
8. Expanded Pediatric Care and Other Services
Descriptions of Expanded Pediatric Care, PANS & PANDAS Care, consultations, specialty services, and other offerings are intended to explain the general nature of services that may be available. Availability, eligibility, scope, pricing, scheduling, and clinical appropriateness may vary.
Shipley Pediatrics may determine that a requested service is not clinically appropriate or that care should be provided or coordinated with another healthcare professional or facility.
9. PANS & PANDAS Information
PANS and PANDAS are complex areas of pediatric care and ongoing medical research. Website information concerning PANS or PANDAS is educational and does not establish a diagnosis or treatment recommendation for an individual child.
There is no single Website symptom list, laboratory result, or online description that can determine whether a child has PANS or PANDAS. Individual clinical evaluation and consideration of other possible causes of symptoms may be necessary.
10. Pricing, Insurance, and Payment Information
We make reasonable efforts to keep Website pricing, membership, insurance, and payment information current. However, prices, fees, eligibility requirements, insurance participation, and service offerings may change.
Website information is not a guarantee of insurance coverage, reimbursement, benefits, eligibility, or out-of-pocket cost. Patients and families are responsible for confirming applicable financial obligations and insurance benefits when relevant.
11. Scheduling and Appointment Requests
Scheduling tools, appointment requests, Meet & Greet requests, and other Website scheduling features are subject to availability. Submission of a request does not guarantee acceptance as a patient, a specific appointment time, or eligibility for a particular service unless and until confirmed through the applicable practice process.
A complimentary Meet & Greet is intended as a non-clinical introductory conversation and is not a medical appointment unless Shipley Pediatrics expressly states otherwise.
12. Privacy
Your use of the Website is also subject to applicable privacy notices and policies. Clinical health information created or maintained by Shipley Pediatrics in connection with patient care may be subject to separate healthcare privacy requirements and the practice's Notice of Privacy Practices.
Third-party websites, scheduling platforms, portals, maps, payment services, or other external services linked from the Website have their own privacy and security practices. Shipley Pediatrics does not control those third-party policies.
13. Intellectual Property
Unless otherwise indicated, Website text, branding, graphics, logos, page design, and original content are owned by or licensed to Shipley Pediatrics and are protected by applicable intellectual property laws.
You may view, download, or print Website materials for personal, non-commercial use. You may not reproduce, republish, distribute, modify, sell, or commercially exploit Website content without prior written permission, except as permitted by law.
14. Permitted Use
You agree to use the Website only for lawful purposes. You may not:
· Attempt to gain unauthorized access to the Website, patient systems, accounts, servers, or networks;
· Interfere with or disrupt Website security, operation, or availability;
· Use automated tools to scrape, copy, or harvest Website content or information in a manner that burdens or disrupts the Website;
· Submit false, misleading, fraudulent, abusive, or unlawful information through Website forms; or
· Use the Website in a manner that violates applicable law or the rights of another person.
15. Third-Party Links and Services
The Website may contain links to third-party websites or services for convenience, including patient portals, scheduling tools, maps, educational resources, or other external services. A link does not necessarily constitute endorsement of all content, products, services, or policies of the third party.
Shipley Pediatrics is not responsible for the availability, accuracy, security, privacy practices, or content of third-party websites or services.
16. Website Availability and Accuracy
We strive to provide accurate and useful Website information, but healthcare information, service offerings, pricing, availability, and other content can change. We do not guarantee that every Website page will always be complete, current, uninterrupted, or error-free.
We may update, modify, suspend, or remove Website content or features at any time.
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Website and its publicly available content are provided on an “as is” and “as available” basis. Shipley Pediatrics disclaims warranties regarding the Website's uninterrupted availability, accuracy, completeness, or fitness for a particular purpose, except where such disclaimers are prohibited by law.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Shipley Pediatrics and Shipley Neuro Pediatrics, LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from use of, or inability to use, the Website or reliance on general Website content.
Nothing in these Terms is intended to waive, limit, or alter rights or responsibilities that cannot lawfully be waived or limited, including obligations arising from an established provider-patient relationship.
19. Children and Website Use
The Website is directed primarily to parents, guardians, caregivers, and individuals seeking information about pediatric healthcare services. Minors should use the Website with the involvement and supervision of a parent or legal guardian where appropriate.
A minor's ability to consent to healthcare or control health information may vary depending on the circumstances and applicable law. These Terms do not determine clinical consent or confidentiality rights.
20. Changes to These Terms
We may revise these Terms periodically to reflect changes in the Website, our services, technology, or applicable requirements. The revised version will be posted on the Website with an updated “Last Updated” date. Continued use of the Website after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.
21. Governing Law
These Terms are intended to be governed by the laws of the State of Montana, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
Any venue or dispute-resolution language should be confirmed by Shipley Pediatrics' legal counsel before publication.
